Public Offer for Course Translation Services

This document is a public offer (the “Offer”) by FitSpace (the “Platform”) to any interested party (the “User”) to enter into an agreement under the terms below.

1. Subject of the Offer

The Platform provides Users with optional access to AI-powered translation and voice dubbing services for fitness courses, designed to enhance accessibility across languages.

2. Acceptance of the Offer

Clicking the “Pay” button and successfully completing payment constitutes full and unconditional acceptance of this Offer. The agreement is concluded immediately upon payment.

3. Scope of Service

Translations and voice dubbing are generated automatically using third-party AI systems, including ElevenLabs for voice synthesis.
All AI-generated audio is labeled as synthetic. The User acknowledges that the output is not a recording of a real human speaker.
The Platform does not control, edit, or review the output. Results may contain inaccuracies, mispronunciations, omissions, or stylistic errors.
This service is provided solely for educational and personal use. It is not intended for professional, medical, legal, financial, or life-critical applications.
By using this service, the User agrees that the translated content is not a derivative work under copyright law, but a technical reproduction for accessibility.

4. Payment Terms

The cost of translation services is displayed at checkout and may vary based on course length and complexity.
Payments are processed through integrated third-party providers (Stripe, Apple IAP, Google Play).
All payments are non-refundable except under the conditions specified in Section 5.

5. Disclaimer of Warranty and Limitation of Liability

The Platform provides AI translations “as is” and “as available.” No warranties, express or implied, are made regarding accuracy, completeness, suitability, or performance.
The Platform disclaims all liability for:
- Errors, omissions, or misinterpretations in translated content;
- Technical failures or limitations of the AI provider (e.g., ElevenLabs);
- Any consequences arising from reliance on translated material, including health, safety, or decision-making risks;
- Changes in the AI provider’s policies, availability, or terms of service.
To the fullest extent permitted by law, the Platform's total aggregate liability to the User shall not exceed the amount paid by the User for the translation service that gave rise to the claim, or USD 100, whichever is greater.
Refunds are available only if the service fails to deliver any output (e.g., translation not generated or inaccessible). Refunds are not granted for dissatisfaction with quality, clarity, or style.
Requests for refunds must be submitted within 14 days of purchase.

6. AI Provenance & Moderation

The Platform relies on AI providers that adhere to responsible AI practices, including ElevenLabs’ AI Safety framework — which includes moderation, accountability, and provenance. The Platform does not store original voice recordings after translation. All outputs are generated on-demand and not retained beyond the session.

7. Final Provisions

The Platform may update this Offer at any time. The current version is always available at fitspace.app/translation-terms. Continued use implies acceptance of changes.
This Agreement is governed by the laws of California, USA.
Any disputes shall be resolved exclusively in the courts of San Francisco, California.

9. Legal Status of the Platform

The Platform acts solely as a technical intermediary and payment facilitator. It does not create, modify, or endorse AI-generated content. Voice synthesis is powered by ElevenLabs; text translation uses other automated providers. FitSpace is not the producer, owner, or legal representative of any AI output. The User acknowledges that the AI provider, not FitSpace, is responsible for the generation, moderation, and compliance of the output.
